Tractor driver sentenced to 2 years jail for killing pedestrian

JAMMU, JUL 12: Special Municipal Magistrate Jammu, Manoj Parihar awarded 2 years imprisonment to Rajinder Kumar tractor driver for killing pedestrian.
Police story is that on 07.10.2008 at 7 p.m. report was received from the reliable sources that one Tractor bearing no. JK02F/3912 driven by accused rashly and negligently, was coming from Gole Pulli towards Poonch House at 4:30 p.m. near Ganda Nallah main road Talab Tilloo. The accused could not keep control on the Tractor, which caused accident with one person Madan Lal getting injured and was admitted to GMC, Jammu, where he succumbed to injury. The investigation was ensued and after investigation offence u/s 279/304-A RPC were proved against the accused.
Special Municipal Magistrate Jammu, Manoj Parihar after hearing Advocate Kunal Chib for the accused and Prosecuting Officer Altaf Wahid for the state observed that the charge against the accused is found to be proved by the prosecution beyond reasonable doubt. The ingredients of offences under section 279 and 304-A are proved against the accused. As such, the accused is found guilty in offence under section 279/304-A RPC and is accordingly convicted and sentenced to undergo simple imprisonment for 6 months under section 279 RPC and 2 years under section 304-A RPC. These two sentences shall run concurrently. JNF
