JAMMU, DEC 22: Justice Alok Aradhe of Jammu and Kashmir High Court at its Jammu Wing extended further by four weeks the time for the Senior Superinte-ndent of Police, Srinagar and SHO Police Station, Nageen Srinagar to file their response/ reply in a writ petition seeking registration of FIR under Section 124-A RPC (Sedition) against Dr. Farooq Abdullah, former Chief Minister and President J&K National Conference for his alleged pro freedom speeches made on the occasion of 111th birth anniversary of Late Sheikh Mohammad Abdullah at Naseem Bagh (Hazratbal), Srinagar and subsequently on February, 24, 2017 at Nawa-e-Subh, Headquarter of National Conference on the occasion of second death Anniversary of former General Secretary of National Conference, Sheikh Nazir Ahmed.
When this writ petition filed by Social Activist Sukesh C. Khajuria came up for hearing Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Suraj Singh and Supriya Chouhan appearing for the petitioner submitted that it was on September 1, 2017 that notices had been issued to SSP Srinagar and SHO Police Station, Nageen in the writ petition seeking monitoring of the preliminary enquiry initiated on petitioner’s complaint for registration of FIR against Former Chief Minister of the State for his pro freedom speeches made on two occasions.
Advocate S.S. Ahmed further submitted that SSP Srinagar is taking the matter very casually and there is no headway in the preliminary enquiry as the same is directed against the former Chief Minister of the State. Advocate Ahmed submitted that it is a fit situation for calling the SSP Srinagar in person before the Court. Advocate Ahmed further submitted that notice be also issued to District Magistrate Srinagar who is withholding vital documents including the compact disc containing the seditious speeches of the former Chief Minister.
Advocate S.S. Ahmed further submitted that the petitioner Sukesh C. Khajuria pursuant to the summons issued by SHO Police Station Nageen appeared before the Investigating Officer and got his statement recorded on September 5, 2017 and despite his full cooperation there is no headway in the preliminary enquiry. Advocate Ahmed further submitted that as per directions of the Apex Court passed in Lalita Kumari V/s State of UP a preliminary enquiry should not exceed 15 days but in the present case the enquiry is kept below the carpet solely for the reason that it is directed against former Chief Minister of the State.
At this stage Advocate Sanchit Verma appearing vice Senior AAG W.S. Nargal submitted that today only the reply has been received from the office of SSP Srinagar and a short adjournment be given for filing reply in the matter.
After considering the submissions of both the sides Justice Alok Aradhe extended time by four weeks for the Senior Superintendent of Police, Srinagar and SHO Police Station, Nageen Srinagar to file their response/ reply in the petition seeking registration of FIR under Section 124-A RPC (Sedition) against Dr. Farooq Abdullah former Chief Minister and President J&K National Conference for his pro freedom speeches.
